The Indore Family Court not only caught a husband’s lie but also ordered him to pay 20,000 rupees as maintenance to his wife every month. Actually, a young woman living in Sindhi Colony, Indore, was married three years ago to a young man who did business in South America (Chile). Everything was perfect at the time of marriage, but cracks appeared in this relationship just a few months after the wedding. When disputes escalated, the husband threw his wife out of the house and kept the child with him. The wife filed a maintenance case in the Family Court. She also alleged that her husband had relations with other women and had installed cameras in her bedroom for surveillance. During the hearing of the case, the husband tried to mislead the court but was unsuccessful. What is this whole matter? Read the report. Business abroad, claim of employment in court According to High Court Advocate KP Maheshwari, the young woman has made serious allegations of physical and mental harassment against her husband. Both were married on February 10, 2022. The husband had been doing business in Chile for the past ten years. After marriage, the wife hoped that she would also go abroad, but the husband did not fulfill his promise. A few months later, disputes arose, and the husband evicted his wife and their one-year-old daughter from the house. He kept the child with him and refused to provide maintenance to his wife. The wife filed a case in the Family Court. In response, the husband told the court that he had closed his foreign business and now works for a transport company in Ulhasnagar, earning 20 thousand rupees a month. Fake documents and expenses revealed the truth The certificate the husband presented in court was not from any transport company in Indore, but from a fake transport service located in Ulhasnagar. He also did not clarify whether he worked there or not. The court estimated his real income from the expenses provided in the husband’s affidavit. He had written that the maid’s salary for the child’s care was 8 thousand, and expenses for parents and himself were 20 thousand, meaning a total of 28 thousand rupees per month. The court said, a person who spends 28 thousand rupees per month, his income must be at least three times that, i.e., 90 thousand to one lakh rupees. Thus, the husband’s false claim got caught in his own figures. Suspicion, surveillance, and domestic violence broke the relationship The root of the dispute was not just money; suspicion and surveillance also hollowed out this relationship. The wife told the court that when her husband went abroad, he would not take her with him. The wife suspected that he had close ties with another woman there. When the wife protested, the husband started suspecting her instead. The husband installed CCTV cameras throughout the house, even fitting a camera in the bedroom. When the wife objected, the husband said it was for security, but the wife called it an insult. Assault during pregnancy, miscarriage, and false accusations The wife stated that when she was pregnant for the first time, she was lured with the promise of taking her abroad. The husband had fake visa documents made, but never took her. When the wife protested, the husband and in-laws severely beat her. During pregnancy, she was kicked in the stomach, which led to her miscarriage. The wife complained to the police, but no action was taken. Later, the husband also accused the wife of theft. Mobile theft case, arrest, and counter FIR When the wife went to her parents’ house, the husband filed a report at Juni Indore police station, alleging that the wife had stolen his brother’s mobile phone. In reality, the husband himself had gifted that phone, but the police registered a case without investigation and arrested the wife. Later, she received bail from the court. Husband’s Defense: Wife Also Has Income Source The husband clarified in court that the wife is financially capable. He stated that the wife is a teacher, earns 20 thousand rupees, has an income of 10-15 thousand from teaching coaching classes, owns a flat which she has rented out, and also earns income from a beauty parlor. The husband also said that he never kicked his wife out of the house. She herself left for her parents’ house after an argument. I wanted to take her abroad, but her mother did not let her go. However, the husband could not prove the wife’s income in court. Citing Supreme Court’s order, husband’s deception exposed During the hearing, the Family Court cited the Supreme Court’s ‘Rajnesh vs. Neha’ case (2020). It stated that both husband and wife must disclose their actual income and expenses with an affidavit. If anyone lies or presents fake documents, they can be sentenced to seven years. Under the same order, when the husband was asked for an affidavit, his deception was exposed. Court’s decision: 20 thousand maintenance to wife every month The Family Court, while giving its decision, said that the husband had abandoned his wife for two years. The daughter is with her, so he will bear the child’s expenses. The responsibility of the wife’s maintenance also rests with him. The court ordered that from the date of abandoning the wife, the husband should pay the wife a lump sum of 4 lakh rupees in arrears. From now on, he should pay 20 thousand rupees as monthly maintenance.
