indore’s-adcp-and-ti-submit-false-affidavit:supreme-court-rebukes-officers,-rejects-‘computer-error’-defence;-grants-bail-to-accused-after-finding-affidavit-misleading

The Supreme Court has strongly criticised two senior police officers from Indore for filing a false affidavit in court. Additional DCP Dishesh Agarwal and Chandan Nagar Police Station In-charge Indramani Patel had told the court that an accused man, Anwar Hussain, was involved in several criminal cases. However, a division bench of Justices Sandeep Mehta and Ahsanuddin Amanullah found that the information was incorrect. Out of the eight cases mentioned in the affidavit, Anwar Hussain was not even an accused in four of them, including one under IPC Section 376. Officers’ Argument Rejected
Taking serious note of the false statement in a matter affecting a citizen’s liberty, the Supreme Court reprimanded both officers and outright rejected their argument that the mistake occurred due to computer generation or matching father-son names. The Court has issued a show-cause notice to TI Indramani Patel. Ordered to appear in person on November 25
The court has ordered both officers and others involved in preparing the false affidavit to appear in court in person on November 25, but an explanation must be submitted two days prior to that. Considering this case suitable for bail, the court has directed the release of petitioner Anwar Hussain on bail.
