A shocking case has come to light from Indore District Court. A disabled government teacher was wrongly taken into custody after his wife got a false recovery warrant issued against him. The court later confirmed that the husband had been wronged. He has now filed a petition demanding strict action against his wife and others involved. False recovery warrant issued The woman had filed a domestic violence case against her husband. The court initially ordered interim maintenance of Rs 8,500 for her and their child. The husband challenged this order in a higher court, which cancelled it. After the cancellation, the wife filed another petition on March 13, 2023, in the District Court of Indore for recovery of the maintenance. Warrant served despite no court order Although the court never issued a warrant, the wife cleverly wrote “recovery warrant to be issued” in the process form. This was sent to the SP of Indore. The SP directed the TI of Hatod Police Station to execute the warrant. On June 21, 2023, the police took the husband into custody and kept him in the lockup overnight. Court orders immediate release The next day, June 22, 2023, the husband was presented in court. His lawyer requested the court to recall the recovery warrant. Upon checking, the court found that no such warrant had been issued in the order book. The husband was immediately released. The court also sought an explanation from the official who issued the false warrant. Complaint against wife filed After his release, the husband filed a complaint at MG Road Police Station, Indore, in February 2025. He alleged that his wife had embezzled Rs 2,80,500 during the ongoing case. He also informed the police about the wrongly issued recovery warrant. Petition submitted to HC On October 13, 2025, the husband submitted a petition to the Chief Justice of Madhya Pradesh High Court, Principal Bench Jabalpur. He demanded strict action against his wife and others who misled the court process writer and judicial officer. The petition states that issuing a warrant without a court order is a serious offence under Sections 245, 246, 247 BNS, punishable with up to two years in prison and a fine. Legal action underway The court has initiated an investigation into the matter. The husband seeks suo motu action against all accused involved in fraud, forgery, and conspiracy.
