The party position of Nirmala Sapre, who won the Bina Assembly seat on a Congress ticket, may become clear during the Rajya Sabha elections. There is no secret ballot in these elections, and MLAs are required to show their vote to a party representative. Any violation of this rule can lead to the vote being cancelled. However, a whip does not apply here, so even if Nirmala votes for a BJP candidate, it will not affect her Assembly membership. In June, three Rajya Sabha seats from the Madhya Pradesh quota are set to fall vacant. The BJP is certain to win two of these seats, while the third, previously held by Congress, has become a point of contention. There are concerns of cross-voting within Congress due to BJP’s efforts for the third seat. The High Court is scheduled to hear a petition seeking cancellation of Nirmala Sapre’s Assembly membership on April 20. Her lawyer has stated that she is a Congress member. The Congress has been asked to prove by April 9 that she has joined the BJP. There is also confusion among local people regarding her party affiliation. Nirmala herself has said that the final decision on her status will be taken by the court. No mention of party on banners and posters As one enters Bina, banners and posters of MLA Nirmala Sapre are visible, but they do not mention any party name or election symbol. At her public contact office near the tehsil office, there are neither BJP nor Congress flags, and the posters only carry the name “MLA Nirmala Sapre”. However, older posters displayed here feature images of Prime Minister Narendra Modi, former Chief Minister Shivraj Singh Chouhan, and Chief Minister Mohan Yadav, along with other BJP leaders, indicating her political inclination. According to observers, this reflects a strategy of silent politics. A local trader, speaking on condition of anonymity, said that if Nirmala openly declares herself a BJP member, her Assembly membership could be at risk, and her victory in a by-election would not be guaranteed. Public Opinion – Confusion, Resentment and Compulsion Conversations with people across different parts of Bina revealed divided opinions on the issue. At Yadav Lassi Stall, Vijay Kumar Oswal said that Nirmala Sapre is seen actively participating in BJP programmes and is seeking support from the government for development works. Ismail Khan said that Sapre was elected as a Congress MLA, and if she contests on a BJP ticket, it would be difficult for her to win, as people voted for Congress. Meanwhile, shopkeeper Chandrabhan claimed that he had voted for Sapre believing her to be a BJP candidate, even though she contested on a Congress ticket. This reflects confusion at the grassroots level. Rajesh Shukla said Sapre has broken public trust by changing her political stance and that her position remains unclear. Lakshmikant Kushwaha called it an insult to the voters, while Ajab Singh Yadav said development is the priority and staying aligned with the ruling party is practical. Final decision depends on Assembly Speaker and court Under the Tenth Schedule of the Constitution (anti-defection law), if an MLA leaves their party or votes against the party whip, their membership can be cancelled. The final decision lies with the Assembly Speaker. Nirmala Sapre’s case falls within this legal framework. She has neither resigned from Congress nor officially announced joining the BJP. Despite her active presence in BJP programmes, she is technically still a Congress MLA. The final decision will depend on the Assembly Speaker and the judiciary. Congress will present evidence of joining BJP The High Court will now hear the matter related to Nirmala Sapre’s Assembly membership on April 20. During the previous hearing on March 31, her lawyer stated that she is a Congress member. Leader of Opposition Umang Singhar has been asked to present evidence by April 9 to prove that she has joined the BJP. According to parliamentary affairs expert Bhagwandev Israni, the final decision will depend on the evidence, and if needed, the situation may become clear during the Rajya Sabha elections.
