shillong-police-to-approach-hc-to-cancel-sonam’s-bail:sp-says,-‘we-are-following-necessary-legal-procedures’;-raj’s-bail-petition-rejected

After the main accused, Sonam, received bail in the murder case of Indore’s prominent transport businessman, Raja Raghuwanshi, a new turn has come in this legal battle. Shillong police is preparing to knock on the doors of Meghalaya High Court to challenge Sonam’s bail. Police believe that Sonam is the mastermind of this murder case, and her release has increased the risk of witnesses in the case being influenced. With bail granted, she can influence the witnesses. On the other hand, on Friday, the Shillong court rejected Raj Kushwaha’s bail petition. Shillong SP Vivek Syiem, while talking to Dainik Bhaskar, said that we are following necessary legal procedures and will continue to take this case forward according to the law. The court has exercised its rights. Our investigation will proceed according to the rules. Police sources said the investigation will rely on the same grounds on which the Shillong Sessions Court granted bail to Sonam. According to sources, the Shillong Police is now working on a strategy to present the evidence and facts in a stronger manner in order to challenge the bail order in the High Court. Meanwhile, government counsel Keshav Gautam has declined to comment on the matter. Sonam Raghuvanshi prepares to file another petition Shillong police sources said that after bail, Sonam has been kept at a safe place in Shillong with the help of a lawyer. The reason is that Sonam cannot leave Shillong without the court’s permission. Meanwhile, according to sources, Sonam herself can file a petition in court to leave Shillong. For this, she can argue that there is a threat of attack on her. It is being said that preparations are being made in this matter by her lawyer. Court rejects Raj’s bail
The court has rejected Raj Kushwaha’s bail. The defense counsel for Raj had argued that keeping the accused in jail for a long time in under-trial cases is a violation of their rights. Usually, accused persons attempt to get bail on the basis of being in jail for more than a year, but the court did not consider it appropriate to give relief to Raj, considering the seriousness of the crime and the facts of the case. After the rejection of Raj Kushwaha’s petition, the path for the other accused also appears difficult. Meanwhile, government lawyer Kesav Gautam stated that the grounds on which Raj Kushwaha’s bail petition was rejected can only be told after seeing the order. The copy of the order is yet to be received. SIT investigating for 10 months In the murder case of Raja Raghuwanshi, a resident of Sahkar Nagar in Indore city, his wife Sonam has been granted conditional bail. While granting bail, the Sessions Court had raised questions on the investigation process of the East Khasi Hills police station in Shillong. Actually, the court found that in Sonam’s arrest records, an inconsistent section was applied instead of the actual section for murder. Along with this, Sonam was not informed about his crime as an accused at the time of arrest. The Sessions Court considered this a serious flaw in the legal process and a violation of the fundamental rights granted to the accused under the Constitution. It was also found that the SIT could not complete the investigation of the case in 10 months. Statements of all witnesses have also not been recorded. Raja’s brother says, ‘We will also go to HC’ Raja Raghuvanshi’s brother, Vipin Raghuvanshi, has said that he himself will also go to the Meghalaya High Court to get Sonam’s bail cancelled. He will file a petition for this. He has already contacted a lawyer for this. Documents have also been sent for the process. Vipin stated that he has spoken with a Supreme Court lawyer regarding this matter. His entire team will work on the case. He had told us earlier that the case is weak, and the accused could take advantage of this. Therefore, now they will look into this case. Soon, an application will be filed in the High Court to reject Sonam’s bail.
