A shocking case has come to light in Gwalior High Court, where a woman, in order to obtain divorce from her husband, claimed her sister-in-law (husband’s sister) to be her co-wife. The woman obtained an ex-parte divorce decree from the Family Court by presenting a family photo as evidence of her husband’s second marriage. Now the husband has challenged this decision in the High Court. Married 28 years ago, living separately since 2015 According to information, the woman (age – 46 years) residing in Gwalior was married in 1998 according to Hindu customs and rituals. The husband is an officer in a marketing company and often stayed away due to work. Due to this reason, disputes between them increased and in 2015 the woman started living separately. Wife approached court in 2021, accused husband of second marriage The woman who had been living separately for about 10 years wanted a divorce at any cost, but the husband was not ready for it. In this situation, in the year 2021, the woman filed a divorce petition in the Family Court and alleged that her husband had remarried. The woman presented a photo as evidence in court, in which her husband was standing with his sister (the woman’s sister-in-law) and other family members. The woman claimed that the sister-in-law present in the same photo was her husband’s second wife and alleged that this woman had broken her home. The court accepted the photo as evidence and declared the husband ex-parte, which meant he didn’t get a chance to present his side, and the woman was granted a divorce decree. Took advantage during mother’s demise The husband alleges that during the entire process, his mother had passed away. He was busy with family responsibilities. Taking advantage of this, the wife got him declared ex-parte and misled the court. The husband learned about the divorce in the first week of April, so he checked the court records. He was shocked to see the photo that was mentioned in them. The person shown as the wife in the photo was actually his own sister. Challenge in High Court, hearing ongoing Now the husband has challenged this ex-parte divorce decree in the High Court on Friday and said that the woman misled the court and obtained the decision through fraud. According to Advocate Dharmendra Sharma, this is a case of misleading the court and presenting false evidence. Currently, the hearing on this is ongoing in the High Court and the further decision will be taken by the court.
