The Madhya Pradesh High Court on Wednesday lifted the interim stay on the arrest warrant issued against Abhishek Banerjee after his counsel repeatedly failed to appear before the court. With this, the relief granted on the warrant issued by the MP-MLA Court in Bhopal has come to an end, clearing the way for his arrest. According to case details, the MP-MLA Court in Bhopal had issued an arrest warrant against Banerjee for failing to appear before the trial court. Challenging the order, he had approached the Madhya Pradesh High Court seeking relief. During the hearing, Banerjee argued that he is an elected Member of Parliament and there was no possibility of him absconding. He also contended that the trial court had not adequately considered his application seeking exemption from personal appearance. Taking note of these submissions, the High Court had earlier granted an interim stay on the arrest warrant. However, with the stay now vacated, the warrant becomes enforceable. Complaint filed in MP-MLA court in 2021 In November 2020, at a rally in Kolkata, Abhishek Banerjee allegedly called Akash Vijayvargiya a ‘goon’. Calling it against his reputation and defamatory, Akash filed a complaint in the MP-MLA court in Bhopal in 2021. After this, the hearing of the case began. Warrant issued for non-appearance During the hearing of the complaint, the MP-MLA court had issued an arrest warrant against Abhishek Banerjee for not appearing in the lower court. After this, he filed a petition in the High Court demanding a stay on the warrant. The High Court had imposed an interim stay on the execution of the warrant during the preliminary hearing. However, in the recent hearing, the court found that despite being given adequate opportunity, there was no effective representation from their side, following which the interim relief was withdrawn. Bhopal MP-MLA Court’s Warrant Becomes Effective Again After the stay on the arrest warrant was lifted, the Bhopal MP-MLA Court’s warrant has become effective again. According to the lower court’s order, further legal proceedings will continue. Action can be taken as per the directions of the concerned court. After the High Court’s decision, Abhishek Banerjee’s legal challenges have increased.
