Parties hoping for a decision on OBC reservation in the Madhya Pradesh High Court have suffered a major setback. The final hearing on the reservation has been postponed for now.

Along with this, new dates for the final hearing have also been announced. The High Court will now hear the case on May 13, 14, and 15. The hearing was postponed due to the non-presentation of the records of the Supreme Court petitions. During the hearing held on Tuesday, the High Court directed the state government to get the records transferred from the Supreme Court. The hearing will begin only after the documents are uploaded. Actually, four pending petitions transferred from the Supreme Court had not been listed yet. Court fixed 3 dates again The hearing on OBC reservation was to be held continuously on April 27, 28, and 29, but it was postponed on the second day itself due to a technical deficiency. During the hearing on Tuesday, April 28, the court has fixed three new dates again. Senior Advocate Rameshwar Singh Thakur says that when the High Court wanted to start hearing OBC cases in January 2025, the government got all the cases transferred to the Supreme Court.

Two advocates, P. Wilshon and Shashank Ratanu, were appointed to conduct the hearing in the Supreme Court. When these advocates demanded records from the government and asked for affidavits from the OIC for the hearing, both advocates were removed. Direction to form special bench and resolve within 3 months The Supreme Court found that the Madhya Pradesh government had wrongly transferred cases from the High Court, Jabalpur, by citing Chhattisgarh matters.

On this, the Supreme Court passed orders on 19 February 2026 and 20 March 2026, sending all cases back to the Madhya Pradesh High Court. It also requested that a special bench be constituted to resolve these cases within a period of 3 months. High Court asks, ‘Who will present the case?’ In the hearing on 27 April 2026, the High Court had sought information from all parties about the time required for arguments. During this, the petitioners’ advocates stated their respective time requirements. Meanwhile, the High Court also asked the Advocate General who would present the case on behalf of the government. On this, the Advocate General took one day’s time. During the hearing held on 28 April, the Advocate General presented the GAD’s order dated 27 April 2026 in the High Court.

It was stated that Solicitor General of the Supreme Court Tushar Mehta and Additional Solicitor General K.M. Nataraj would present the case on behalf of the government. Senior advocates Rameshwar Singh Thakur, Vinayak Prasad Shah, Varun Thakur, Shashank Ratanu, Pushpendra Shah, Akhilesh Prajapati, Uday Kumar Sahu, Ramesh Prajapati, and Parmanand Sahu appeared on behalf of the OBC category.
